The terms governing access to and use of GooScale services
These Terms and Conditions of Sale (TCS) govern the contractual relationship between GooScale (hereinafter 'the Provider') and any client (hereinafter 'the Client') wishing to subscribe to its online services.
By placing an order or accessing GooScale services, the Client acknowledges having read, understood and accepted these TCS without reservation. GooScale reserves the right to modify these terms at any time, with new terms taking effect upon publication on the website.
GooScale offers SaaS (Software as a Service) optimization and management services for businesses. The main available offerings are:
Access to basic platform features for small structures and freelancers.
Extended access to advanced features, suited for growing teams.
Complete and customizable solution for large organizations, with dedicated support.
Subscription to a GooScale service is done exclusively online via gooscale.com. The contract is formed on the date of the order confirmation email sent to the Client.
The Client selects the plan matching their needs from the available options on the Pricing page.
The Client creates an account by providing accurate and up-to-date information (name, email, billing details).
The Client validates their order and proceeds with payment via our secure system. Confirmation is sent by email.
After payment confirmation, the Client immediately gains access to the subscribed services via their personal dashboard.
Our service prices are listed in euros (€) excluding tax (HT) and including tax (TTC) on our Pricing page. GooScale reserves the right to modify its prices at any time, subject to 30 days' notice for ongoing subscriptions.
Monthly subscriptions are billed at the start of each period. Annual subscriptions include a discount and are billed in a single payment. An invoice is automatically generated and accessible in the client dashboard.
In accordance with applicable consumer protection law, the Client has a 14-calendar-day period from the date of subscription to exercise their right of withdrawal, without providing any reason.
The right of withdrawal does not apply if the Client has expressly requested the execution of the service before the expiry of the withdrawal period and acknowledged losing this right once the service is fully executed.
To exercise this right, the Client must notify GooScale by email at contact@gooscale.com clearly stating their decision to withdraw. The refund will be processed within 14 days of receiving the notification.
GooScale is committed to providing its services with all necessary care and diligence. However, our liability is limited under the following conditions:
GooScale shall not be held liable for any indirect, consequential or intangible damages (loss of revenue, data loss, reputational damage) resulting from the use or inability to use the services.
GooScale's total liability to the Client shall not exceed the amounts actually paid by the Client during the 12 months preceding the event giving rise to the dispute.
GooScale cannot be held responsible for any failure to meet its obligations in cases of force majeure as defined by applicable law.
All elements constituting the GooScale platform (software, trademarks, logos, interfaces, algorithms, documentation) are and remain the exclusive property of GooScale.
GooScale grants the Client a non-exclusive, non-transferable and revocable license, limited to the duration of the subscription and strictly necessary for the use of the subscribed services.
The Client retains full ownership of their data imported or generated via the platform. GooScale undertakes not to use such data for any purpose other than providing the service.
The contract may be terminated under the following conditions:
The Client may cancel their subscription at any time from their personal dashboard. Termination takes effect at the end of the current subscription period, with no refund for unused time.
GooScale may terminate the contract with 30 days' notice, or immediately in the event of a serious breach by the Client of their obligations (non-payment, misuse, violation of TCS).
On the effective date of termination, access to the services is suspended. The Client has 30 days to export their data before permanent deletion.
These TCS are governed by applicable law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, the dispute will be submitted to the competent courts.
Consumer clients may use a certified consumer mediator free of charge to resolve disputes amicably before resorting to legal proceedings.
